Privacy Vitam-app

Deze privacyverklaring geldt voor de Vitam applicatie van V’Business B.V. (hierna: “Vitam” of “wij”). Via deze privacyverklaring willen wij je graag informeren over de manier waarop wij omgaan met jouw persoonsgegevens.

Vitam is de verantwoordelijke voor de verwerking van persoonsgegevens in kader van de Vitam applicatie. Wij vinden privacy erg belangrijk en verwerken je persoonsgegevens uitsluitend in overeenstemming met de geldende privacywetgeving, onder andere de Algemene Verordening Gegevensbescherming en de Telecommunicatiewet.

In deze privacyverklaring wordt uiteengezet welke persoonsgegevens door ons worden verwerkt wanneer je onze applicatie gebruikt of naar aanleiding daarvan contact met ons zoekt. Met persoonsgegevens bedoelen wij alle gegevens die iets zeggen over jou of met jou in verband kunnen worden gebracht. Mocht je na het lezen van deze privacyverklaring vragen hebben, kun je altijd contact opnemen met Vitam via de contactgegevens onderaan deze privacyverklaring.

Jouw persoonsgegevens

Voor de verwerking van je persoonsgegevens is een wettelijke grond vereist. Wij verwerken je persoonsgegevens dan ook uitsluitend op grond van een wettelijke basis. Zo worden je persoonsgegevens verwerkt op grond van jouw toestemming daartoe, ter uitvoering van een overeenkomst, voortvloeiend uit een wettelijke verplichting of indien Vitam of een andere partij hiertoe een gerechtvaardigd belang heeft. Wanneer de verwerking van je persoonsgegevens (enkel) op basis van je toestemming daartoe wordt gebaseerd, heb je altijd het recht om deze toestemming in te trekken.

Wij zullen je persoonsgegevens in beginsel niet voor een ander doeleinde verwerken dan in deze privacyverklaring wordt aangegeven. Daarnaast zullen wij je persoonsgegevens niet langer bewaren dan noodzakelijk is, tenzij wij daartoe wettelijk zijn verplicht.

Wij lichten hieronder in meer detail toe welke persoonsgegevens wij verwerken voor welke doeleinden en op basis van welke wettelijke grondslag deze verwerkingen plaatsvinden.

Een account aanmaken

Om bestellingen via de Vitam applicatie te kunnen plaatsen, dien je een persoonlijk account aan te maken. Bij het aanmaken van een account vragen wij je om je voor- en achternaam, (werk-gerelateerde) e-mailadres en telefoonnummer. Deze accountgegevens gebruiken wij enkel om jou de Vitam applicatie aan te kunnen bieden en om vervolgens jouw bestellingen uit te kunnen voeren.

Wij verwerken deze accountgegevens in beginsel zo lang jouw Vitam account niet verwijderd is. Wanneer je aangeeft je account zelf te willen verwijderen, zien wij dit als een verzoek tot verwijdering van je persoonsgegevens. Hierbij hanteren wij de procedure zoals beschreven in deze privacyverklaring. Wanneer je account inactief is voor een aaneengesloten periode van één jaar zullen wij je account verwijderen, tenzij je aangeeft het account te willen behouden. Onder inactiviteit verstaan wij het gedurende deze periode niet plaatsen van een bestelling of anderszins acties verrichten in of via jouw account, zoals het doorvoeren van een wijziging van jouw accountgegevens. Op dat moment zullen wij ook je persoonsgegevens verwijderen of geanonimiseerd archiveren voor zover de verdere verwerking hiervan niet langer noodzakelijk is voor een ander doeleinde.

We bieden de mogelijkheid om de gegevens omtrent je bestellingen, zoals de inhoud ervan, het bedrag, de datum en het tijdstip van de levering vast te leggen in een bestellingenoverzicht, zodat je overzichtelijk je bestelgeschiedenis kunt inzien. We verwerken deze gegevens in dit overzicht op basis van jouw toestemming of in onze eigen administratie omdat dit noodzakelijk is op grond van een wettelijke plicht of ter uitvoering van de overeenkomst.

Versturen van aanbiedingen

Als gebruiker van de Vitam applicatie kunnen wij je per e-mail informeren over (soortgelijke) producten of diensten van Vitam of onze dienstverlening zelf op basis van een gerechtvaardigd belang daartoe, tenzij je hebt aangegeven dat je deze berichten niet wenst te ontvangen. Zo kun je na het plaatsen van een bestelling aangeven dat je geen e-mails wilt ontvangen over (soortgelijke) producten of services van Vitam. Wij bieden je ook onderaan iedere e-mail de mogelijkheid om je af te melden voor dergelijke berichten.

Het bestelproces

Bij het plaatsen van een bestelling verwerken wij in ieder geval je voor- en achternaam, bestel-, transactie- en betaalgegevens. Deze persoonsgegevens zijn nodig voor het doorgeven van jouw bestelling aan de betreffende locatie en het uitvoeren van je bestelling, de betaling en eventuele terugbetaling. Daarnaast geven wij je de optie om allergieën of intoleranties aan te geven. Deze informatie verwerken wij ten behoeve van jouw gezondheid en voorkeuren. Ook geven wij je de optie om je telefoonnummer te verschaffen. Dit telefoonnummer kunnen wij gebruiken wanneer het nodig is om contact met je op te nemen over jouw geplaatste bestelling.

Wij verstrekken slechts je voor- en achternaam, bestelgegevens en allergieën of intoleranties aan het restaurant, café of bar waar je je bestelling hebt plaatst. Deze verwerking van deze gegevens is noodzakelijk voor de uitvoering van je bestelling en maakt het mogelijk dat je je bestelling kunt afhalen.

Opmerking over de verwerking? Dit kun je doen.

Omdat wij je persoonsgegevens verwerken, heb je het recht om:

• inzage te krijgen in je persoonsgegevens die door Vitam worden verwerkt;
• eventuele onjuiste of onvolledige persoonsgegevens aan te passen;
• de verwerking en het gebruik van je persoonsgegevens te laten beperken, indien:
  • je de juistheid van deze gegevens betwist tijdens de periode die Vitam nodig heeft om die juistheid controleren;
  • verwerking onrechtmatig is en je je verzet tegen het verwijderen van deze gegevens;
  • Vitam de gegevens niet meer nodig heeft, maar je deze gegevens wél nodig hebt in het kader van het instellen, uitoefenen of onderbouwing van een rechtsvordering; of
  • je bezwaar hebt gemaakt tegen de verwerking die is gebaseerd op een gerechtvaardigd belang van Vitam of een derde, en in afwachting bent van een reactie van Vitam;
• je persoonsgegevens te laten verwijderen, indien:
  • je gegevens niet langer nodig zijn;
  • je je toestemming intrekt (en de verwerking niet op een andere grond kan worden gebaseerd);
  • je bezwaar maakt tegen de verwerking;
  • de gegevens onrechtmatig zijn verwerkt; of
  • de gegevens moeten worden gewist op grond van een wettelijke verplichting van Vitam;
• de overdracht van je persoonsgegevens te bewerkstelligen. Indien technisch mogelijk, kun je Vitam ook verzoeken om deze gegevens rechtstreek naar een andere verwerkingsverantwoordelijke te verzenden;
• bezwaar te maken tegen de verwerking van jouw persoonsgegevens in het kader van direct marketing of vanwege jouw specifieke situatie voor zover de verwerking op grond van een gerechtvaardigd belang plaatsvindt.

Je kunt je verzoek (of klacht) met betrekking tot de verwerking van je persoonsgegevens zowel per e-mail (info@vitam.nl) als per post verzenden. Wij verwijzen je hiervoor ook graag naar de contactgegevens die je onderaan deze privacyverklaring vindt.

Wanneer je een verzoek in verband met de verwerking van je persoonsgegevens indient bij Vitam, zullen wij je zo snel mogelijk maar niet later dan één maand na ontvangst van je verzoek een reactie toesturen. Deze termijn kan worden verlengd met twee maanden, afhankelijk van het aantal verzoeken en de complexiteit hiervan. Ook van deze eventuele verlenging brengen wij je op de hoogte. Een afwijzing van je verzoek zal worden gemotiveerd. Buitensporige verzoeken kunnen wij buiten behandeling laten. Om er zeker van te zijn dat een verzoek door jou zelf is gedaan, kunnen wij je in bepaalde situaties vragen om je identiteit te bevestigen.

Mocht je het niet eens zijn met de inhoud van de reactie, de afwijzing van je verzoek of de verwerking van je gegevens door Vitam anderszins, dan heb je altijd het recht om een klacht in te dienen bij de Autoriteit Persoonsgegevens. Daarnaast heb je ook het recht om een beroep in te stellen bij de daartoe bevoegde rechter.

Veiligheid

Vitam streeft ernaar om de veiligheid van jouw persoonsgegevens te waarborgen. Wij gebruiken diverse beveiligingstechnologieën en -procedures om jouw persoonsgegevens te beschermen tegen ongeoorloofd gebruik en ongeoorloofde toegang of openbaarmaking. De persoonsgegevens die je aan ons verstrekt, worden bijvoorbeeld opgeslagen op computersystemen die beperkt toegankelijk zijn en zich bevinden in faciliteiten die eveneens beperkt toegankelijk zijn. Wanneer je persoonsgegevens opvraagt, gebruiken wij beveiligingstechnologieën die voldoen aan de industriële standaard, zoals het SSL-protocol (Secure Socket Layer), om deze informatie gecodeerd te verzenden via internet.

Verstrekking aan derden

In sommige gevallen maken wij gebruik van de diensten van derden om jouw gegevens te verwerken. Zo sturen wij zoals hierboven aangegeven gegevens omtrent je bestelling naar het restaurant of de koffiebar waarbij je je bestelling plaatst. Daarnaast maken wij gebruik van de diensten van cloud service providers en betalingsproviders zoals iDeal. In het geval de partijen waar Vitam mee samenwerkt, worden gezien als verwerker, hebben wij in een verwerkersovereenkomst afspraken gemaakt met deze partijen over passende technische en organisatorische beveiligingsmaatregelen. Persoonsgegevens zullen bijvoorbeeld enkel worden verwerkt in opdracht van Vitam. Jouw gegevens zijn dus in veilige handen.

Bewaartermijnen en verstrijking

Persoonsgegevens mogen niet langer worden bewaard dan noodzakelijk is. Voor sommige gegevens geldt een wettelijke bewaartermijn en voor andere gegevens geven wij in deze privacyverklaring een bewaartermijn af. Indien de bewaartermijn is verstreken, worden de gegevens verwijderd, of geanonimiseerd en gearchiveerd. Gearchiveerde en geanonimiseerde gegevens kunnen wij na afloop van de bewaartermijn nog voor historische, statistische of wetenschappelijke doeleinden gebruiken.

Wijziging privacyverklaring

De manier waarop wij persoonsgegevens verwerken en de samenstelling of hoeveelheid van gegevens die wij verwerken, kan wijzigen. Daarom behouden wij ons het recht voor deze privacyverklaring aan te passen. Wij adviseren je dan ook geregeld de privacyverklaring te raadplegen, zodat je goed op de hoogte blijft. De actuele versie tref je altijd aan op onze website. Wij zullen je persoonsgegevens alleen verwerken in overeenstemming met de privacyverklaring ten tijde van het verzamelen van je persoonsgegevens.

Privacy statement Vitam-app

This privacy policy applies to the Vitam application supplied by V’Business B.V. (hereinafter referred to as ‘Vitam’ or ‘we’). The purpose of this privacy policy is to provide you with information on how we handle your personal data.

Vitam is responsible for processing personal data within the context of the Vitam application. We believe that privacy is very important and only process your personal data in accordance with current privacy legislation, including the General Data Protection Regulation and the Telecommunications Act.

This privacy policy explains which personal data we process when you use our application or when you contact us in connection with this application. Personal data is taken to mean all data that says something about you or which can be linked to you. If you have any questions after reading this privacy policy, you can always contact Vitam using the contact details provided at the bottom of this policy.

Your personal data

We need a legal basis to process your personal data. We will therefore only process your data if there is a legal basis to do so. This means that your personal data is processed if you give us your consent to do so, for the purpose of carrying out an agreement, if there is a statutory obligation to do so, or if Vitam or another party has a legitimate interest to do so. If your personal data is only processed because you provide consent for this purpose, you have the right to withdraw this consent at any time.

In principle, we will not process your personal data for any other purposes than specified in this privacy policy. In addition, we will not keep your personal data any longer than necessary, unless we are obliged to do so by law.

We explain below in more detail what personal data we process for which purposes and on which legal basis this processing is carried out.

Creating an account

In order to place orders using the Vitam application, you need to create a personal account. When you create an account, we ask you for your first and last names, your work-related or other e-mail address, and your telephone number. We will only use these account details to offer you the Vitam application and to subsequently process the orders that you place.

In principle, we will only process these account details for as long as your Vitam account is not deleted. If you state that you wish to delete your account yourself, we will regard this as a request to erase your personal data. In doing so, we follow the procedure set out in this privacy policy. If your account is inactive for a continuous period of one year, we will delete your account unless you state that you wish to keep it. ‘Inactive’ is taken to mean that no orders have been placed or any other actions carried out in or via your account during this period, such as making changes to your account details. At that time, we will also erase your personal data or archive your information anonymously if further processing of the data is no longer needed for any other purpose.

We provide the option of recording the details relating to your orders, such as the order content, order cost, and date and time of delivery, in an order summary so that you have a clear overview of your order history. We process the data in this summary either based on your consent or in our own administrative records if needed on the basis of a legal obligation or in order to carry out the agreement.

Sending special offers

As a user of the Vitam application, we can send you an e-mail containing information about similar products and services we offer or about the service we provide based on a legitimate interest to do so, unless you have stated that you do not wish to receive these messages. After placing an order, you can state that you do not want to receive e-mails about other similar products or services that Vitam provides. We also give you the option to unsubscribe from these types of messages at the bottom of every e-mail.

Ordering process

When you place an order, we will process your first and last names and your order, transaction, and payment details at the very least. These personal details are needed to forward your order to the relevant location and to carry out your order and handle the payment and possible refund. In addition, we give the option of specifying any allergies or intolerances. We process this information in the interest of your health and to cater for any preferences you may have. We also give you the option of providing your telephone number. We may use this telephone number if we need to contact you in regard to the order you have placed.

We will only pass on your first and last names, order details, and any allergies or intolerances to the restaurant, café, or bar where you placed your order. This data needs to be processed in order to carry out your order and make it possible for you to collect it.

If you have any comments on how we process your data, you can do the following.

Because we process your personal data, you have the right to:

• request to view your personal data that is being processed by Vitam
• request the amendment of any incorrect or incomplete personal data
• request to limit the processing and use of your personal data if:
  • you are contesting the accuracy of this data, for the duration that Vitam needs to check this accuracy
  • processing is unlawful and you oppose the removal of this data
  • Vitam no longer needs the data but you need this data in order to establish, exercise, or defend a legal claim, or
  • you have objected to the processing that is based on a legitimate interest on the part of Vitam or a third party and are awaiting a response from Vitam
• request erasure of your data if:
  • your details are no longer needed
  • you withdraw your consent (and processing cannot be based on other grounds)
  • you object to the processing of your data
  • your data has been processed unlawfully, or
  • Vitam has a statutory obligation to erase the data
• arrange for the transfer of your personal data. If it is technically possible, you can also ask Vitam to send this data directly to another controller
• object to the processing of your personal data for the purpose of direct marketing or because of your specific situation insofar as processing takes place on the basis of a legitimate interest.

You can send your request (or complaint) in regard to the processing of your personal data either by e-mail (info@vitam.nl) or by post. Please also refer to the contact details shown at the bottom of this privacy policy.

If you submit a request in relation to the processing of your personal data to Vitam, we will send you a response as quickly as possible but no later than one month after receiving your request. This deadline may be extended by two months, depending on the number and complexity of the requests. We will inform you if an extension is needed. If we reject your request, we will provide reasons. Any excessive requests will not be considered. In order to make sure that a request has come from you, we may ask you to confirm your identity in certain situations.

If you do not agree with the content of a response, the rejection of your request, or the processing of your data by Vitam in other respects, you will always have the right to submit a complaint to the Dutch Data Protection Authority (Dutch DPA). In addition, you also have the right to lodge an appeal with the competent court.

Safety

Vitam endeavours to ensure that your personal data is kept safe. We use various security technologies and procedures to protect your personal data against unauthorized use and unauthorized access or disclosure. For example, the personal data that you provide to us is stored on computer systems with restricted access and which are located in facilities that also have restricted access. If you request personal data, we use security technologies that comply with the industry standard, such as the SSL protocol (Secure Socket Layer), to send this information encrypted via the internet.

Disclosure to third parties

In some cases, we use the services of third parties to process your data. For example, as mentioned above, we send information about your order to the restaurant or café where you have placed your order. In addition, we use the services of cloud service providers and payment providers such as iDeal. In the event that the parties with whom Vitam cooperates are regarded as processors, we have made agreements with these parties in a processing agreement regarding suitable technical and organizational security measures. Personal data will only be processed if instructed by Vitam, for instance. Your data is therefore in safe hands.

Retention periods and expiration

Personal data must not be kept for longer than necessary. Some data is subject to a legal retention period, and for other data we issue a retention period in this privacy policy. Once the retention period has elapsed, the data is either erased or anonymized and archived. We can still use archived and anonymized data after the end of the retention period for historical, statistical, or scientific purposes.

Changes to privacy policy

Changes may be made to the way in which we process personal data and to the composition or quantity of the data that we process. We therefore retain the right to make changes to this privacy policy. As a result, we advise you to consult this privacy policy regularly in order to stay informed. You will always find the current version on our website. We will only process your personal data in accordance with the privacy policy at the time that your personal data is collected.
